SHIPPING TERMS AND CONDITIONS:
1. Shipment means all parcels, boxes, cargo, and documents tendered by the sender under one transaction or receipt to be carried by EAGLE CARGO through a nominated sea freight carrier, consolidator, or freight forwarding partner.
2. All shipments are transported on a limited ability basis unless additional insurance coverage is purchased and agreed in writing by EAGLE CARGO prior to shipment acceptance.
3. The sender is obligated to truthfully and accurately declare all contents contained in the shipment. Failure to declare contents correctly may result in seizure, confiscation, customs penalties, refusal of shipment, legal prosecution, or forfeiture of any liability claim against EAGLE CARGO.
4. For lost or damaged shipments without declared value and approved insurance coverage, EAGLE CARGO liability shall be limited to refund of freight charges only regardless of actual shipment contents or value.
5. For shipments with declared value accepted by EAGLE CARGO, liability shall be limited to a maximum of AUD $300 unless separate insurance has been purchased.
6. EAGLE CARGO shall not be liable for delays, losses, damages, confiscations, inspections, or additional charges arising from customs authorities, quarantine inspections, acts of government agencies, weather disturbances, force majeure events, port congestion, vessel schedule changes, strikes, industrial action, or events beyond reasonable control.
7. EAGLE CARGO shall not be liable for damages arising from leakage, improper packaging, fragile items, internal shifting, liquid spills, spoilage, opened food items, mold, rust, corrosion, breakage, or inadequate sealing performed by the sender.
8. The sender warrants that the shipment does not contain hazardous or prohibited goods including but not limited to explosives, flammable substances, compressed gases, firearms, firearm parts, ammunition, illegal drugs, chemicals, toxic substances, counterfeit goods, live animals, or any item prohibited under Australian or Philippine law.
9. EAGLE CARGO reserves the right to inspect, open, verify, or refuse acceptance of any shipment suspected of containing undeclared, prohibited, unsafe, or illegal goods in accordance with customs, quarantine, transport, and maritime regulations.
10. Delivery schedules and transit times are estimates only and are subject to sailing schedules, customs clearance procedures, weather conditions, shipping line schedules, local delivery conditions, and destination operational factors.
11. Storage fees, return fees, warehouse handling fees, or disposal of shipment in accordance with local laws and operational procedures may apply.
12. All claims for loss, damage, or shortage must be submitted in writing to EAGLE CARGO within thirty (30) days from shipment or delivery date together with supporting evidence and documentation.
13. EAGLE CARGO shall not be liable for indirect, incidental, consequential, punitive, business, emotional, or exemplary damages including loss of profit, sentimental value, or business interruption.
14. Any court action or legal dispute arising from this transaction shall be brought before the proper courts of Queensland, Australia unless otherwise determined by applicable law.
15. By signing below, the sender confirms that they are of legal age, have full authority over the shipment, and have read, understood, and agreed to all EAGLE CARGO terms and conditions.
